Motorcycle accident - Travel insurance refused to pay!

I have just returned from a vacation in Thailand, I was only supposed to be there for 3 weeks, had to stay 5 weeks, the last 2 in hospital.

I had a motorcycle accident on Jomtien beach road late at night, entirely not my fault, a drunken tourist walked out in front of me. The police report says as much.

I spent 2 weeks in hospital and ran up a hospital bill of 119,000 Baht, that's about £2400, I figured no problem my travel insurance would cover it.

Oh how wrong I was! They have refused to pay out, as they say I was not wearing a crash helmet at the time (which I was), when I queried this they tell me the police report says I was not!?!

What can I do here? Can I appeal? How do I try and get this resolved? I can't imagine how I would go about having a police report in Thailand changed?

My advice to you is to forget it, swallow the loss of cash and move on.

There is no way you are going to be able to get a police report already lodged in Thailand changed from your home country. I doubt you could even do it if you were in Thailand and spoke to the police officer who wrote the report.

Bad news I know, but no point keeping your hopes up.

This is one of the famous small print items with travel insurance, no crash helmet, it's beyond a joke really and travel insurance providers should stop these kinds of policies.

Anyway, at least you are back home and healing up.

The previous poster is correct, it is highly unlikely you can have the insurance company change their decision.

You could try contacting somebody like the FSA link below:

Although it is unlikely they can do much.

Who did you buy your travel insurance from? Maybe you should name and shame them so we can avoid them.
